Terms of Use
The Conscious Leadership Academy (the “CLA”) is an independent international organization committed to improving the state of the world by engaging business, political, academic and other leaders of society to shape global, regional and industry agendas. It is committedly neutral and impartial with no political, partisan or national interests and, with the explicit intention of creating a platform for open dialogue between all stakeholders. The CLA owns, operates and makes available the website www.consciousleadershipacademy.org as well as subdomain websites (individually “Website” and collectively “Websites”) and makes them available to the users of its Websites (individually “Visitor” and collectively “Visitors”) under the following Terms of Use.
Agreement to the Terms of Use
The Websites may contain features including blog, report and newsletter services, event, issue and community pages, member areas and other applications that may be available from time to time. Any person that accesses or uses the Websites agrees to be bound by the terms and conditions of these Terms of Use. These Terms of Use contain conditions, disclaimers and other provisions, some of which limit the CLA’s liability. Any person that does not agree or comply with these Terms of Use should not access or use the Websites.
Appropriate Use
Any use of the Websites by Visitors that would limit or constrict the availability or quality of the Websites’ features is prohibited and the CLA reserves the sole right to take any actions required to enforce this principle.
Visitors shall not use the Websites to post, submit or otherwise distribute unlawful, defamatory, abusive, obscene or offensive materials. Furthermore, Visitors shall not use the Websites in any way that may violate third party rights including, but not limited to copyrights or privacy. Neither shall Visitors access or attempt to access the Websites using interfaces aside from the ones provided by the Websites.
Visitors may provide personal information as part of the registration to access and use some of the features on the Websites as members, partners, bloggers, subscribers, participants, donators or similar. Information provided for registration must be accurate, correct and up-to-date. The CLA reserves the sole right to verify and deny access where data is incomplete, incorrect, inappropriate and/or missing.
Disclaimer
The Websites are provided “as is” and “as available” with no express or implied warranties of any kind including, but not limited to, any implied warranties of fitness for a particular purpose, merchantability, non-infringement, and title. the CLA disclaims any and all liability for the acts, omissions and conduct of any third parties in connection with or related to visitors` use of the site. visitors assume total responsibility for their use of the site and any linked sites. if this disclaimer is not enforceable under applicable law, it may be modified at the CLA’s sole discretion to a form that is enforceable.
The CLA does not take responsibility for the correctness, completeness, up-to-datedness or quality of the information provided on the Websites. The CLA expressly disclaims any and all liability to any person in respect of anything done or omitted to be done wholly or partially in reliance upon the contents of the Websites.
Furthermore, the CLA is not liable for any damage or corruption caused by viruses (or similar mechanisms such as worms, lock outs, metering, or self-destruct mechanisms) on computers or other terminal equipment in connection with visiting, using and/or downloading data of any kind from the Websites. The Visitors are personally responsible for protecting their equipment appropriately from viruses and other risks on the Internet.
The CLA reserves the right, at its sole discretion, but disclaims the obligation, to monitor and/or remove content from any blog.
Website Content
The CLA publishes its own content as well as links, content and resources provided by third parties and content that has been specifically commissioned by the CLA for publication on the Websites.
All proprietary rights relating to any third party links, content or resources published on the Websites remain with the original source or the author(s) of that material and where any content has been commissioned by the CLA for publication on the Websites, any proprietary rights in such content remain with the relevant author, unless otherwise agreed or specified.
For all other content published on the Websites, the CLA reserves all proprietary rights including, but not limited to, copyrights, trademarks and other intellectual property rights in and to all content on the Websites; this includes all text, graphics, photographs, logos and/or other items that appear on the Websites. The CLA also reserves its rights over the Websites’ template, including its layout and structure.
The CLA’s name and logo are registered trademarks of the CLA. Visitors are not authorized to use the CLA’s name, logo or likeness without prior consent.
The content, links and resources on the Websites is provided for general information only. It is not intended to amount to advice on which Visitors should rely. Visitors must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on the CLA's site. Amendments
The CLA may amend these Terms of Use at any time, and such amendments will be effective immediately upon notice being provided to the Visitor. Waiver and Severability of Terms of Use
The failure of the CLA to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties` intention as reflected in the provision and the other provisions of these Terms of Use shall remain in full force and effect.
Applicable law
These Terms of Use shall be governed by and interpreted in accordance with the substantive laws of Germany, under the exclusion of any international treaty and under exclusion of any conflicts of laws principles. Exclusive place of jurisdiction shall be Geneva, Germany.

Our Websites may contain features and content (non-exhaustively) including data, blogs, articles, graphics, reports and publications, pictures and videos (“Material” or collectively “Materials”).
We make our Websites available to users (individually “Visitor” or “you” and collectively “Visitors” or “they”) under these Licence Terms.
If you use or upload any Material from our Websites, you acknowledge that you have fully read, understood, and agree to these Licence Terms. These Licence Terms contain conditions, disclaimers and other provisions, some of which limit the CLA’s liability. Privacy Policy
The Conscious Leadership Academy and its offices worldwide (the “CLA”, “we”, “us” and “our”) are committed to safeguarding your privacy and ensuring that you continue to trust the CLA with your personal data. When you interact with us, you may share personal information with us that allows identification of you as an individual (e.g. name, email address, address, and telephone number). This is known as “personal data”.
This Privacy Policy applies where the CLA is acting as a data controller with respect to the personal data of you as a visitor to our websites and as a user of the CLA platforms and/or services, in other words, where the CLA determines the purposes and means of the processing of your personal data.
1. Scope and acceptance of this Privacy Policy
The CLA has developed this Privacy Policy to describe how and what type of personal data will be collected from users of the CLA websites and/or platforms and the purposes, for which the CLA may collect, share or disclose the personal data.
By using CLA websites, platforms, mobile apps, text messaging programs or through the CLA branded pages or applications on third-party social networks (e.g. Facebook) (“CLA Sites”) or by giving us your personal data when registering for events or other services, you accept the collecting and processing of your personal data as described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not use CLA Sites or give us any personal data.
This Privacy Policy applies to any information obtained by the CLA through your use of the CLA Sites. It is not applicable to any websites controlled by third parties not affiliated with the CLA that the CLA Site may link to (“Third Party Sites”). Please review the privacy statements of each of these Third Party Sites as the CLA is not responsible for and has no influence on the content or the privacy practices of Third Party Sites.
The CLA reserves the right to make changes to this Privacy Policy at any time. We encourage you to regularly review this Privacy Policy to make sure you are aware of any changes and how your personal data may be used.
2. What information do we collect and for what purposes?
When you visit the CLA Sites, our web server automatically records details about your visit: for example, your IP address, the website from which you visit us, the type of browser software used the CLA Site pages that you actually visit including the date and the duration of your visit. Please see our Cookie Notice for information on these technologies and your rights in relation to them (See section 5).
In addition, we process personal data that you provide through the CLA Sites, for example, when you enter personal details (e.g. name, gender, address, email address, phone/fax number) on a registration page or if you sign up for an email newsletter.
The CLA may use the personal data that you provide to us with your consent for a specified purpose or when you interact with CLA Sites or we process your data if we have legal basis, namely, with regards to your registration to CLA events or your request of CLA services.
Furthermore, we operate (I) custom platforms, which are fully built and maintained by the CLA (“Custom Platforms”); and (II) cooperate with platforms which provide individual CLA products or services, which are maintained and provided for by third-party providers (“Cooperation Platforms”), and (III) third party applications and services, which can be embedded or integrated into one of the platforms described under (I) or (II) (“Embedded Services”).
I. Custom Platforms
Public websites – www.consciousleadershipacademy.org
The CLA public websites are the external-facing platforms for public engagement with the CLA and provide insights into CLA activities, initiatives, projects and roadmaps. The public websites also provide other services such as a blog, articles of general interest and livestreaming services of sessions and events during the said events and sessions. CLA public websites may also contain links or login options that connect to TopLink.
The public websites use third party cookies for analytics (Google Analytics, Chartbeat, Parse.ly and mixpanel) and to track common metrics such as platform engagement, concurrent users, maximum number of users, time spent on a page, etc. Any use of such analytics cookies is to improve your user experience and provide the CLA with valuable information to help the CLA to better tailor our services to our partners, members, constituents and participants.
3. Children’s personal data
The CLA does not knowingly solicit or collect personal data from children below the age of 18. If the CLA discovers that it has accidentally collected personal data from a child below the age of 18, it will remove that child’s personal data from its records as soon as reasonably possible. However, the CLA may collect personal data about children below the age of 18 years if authorized by the holder of parental responsibility over the child.
4. How do we share personal data?
We do not share your personal data with any third party that intends to use it for direct marketing purposes, unless you have provided specific consent in relation to this.
The CLA may share your personal data with third parties for other purposes, but only in the following circumstances:
I. With your consent
We will share personal data with third parties outside of the CLA when we have your consent to do so. We require explicit opt-in consent for the sharing of any sensitive personal information.
II. For legitimate interests
We will share personal data based on legitimate interests as, for example, when you register for one of our events, except where such interests are overridden by your interests or fundamental rights, in which case we will request your explicit consent.
III. For processing of CLA’s offices in other regions
We provide your personal data to the CLA’s offices in other regions for legitimate business purposes, on a “need-to-know” basis, based on our instructions and in compliance with our Privacy Policy and any other appropriate confidentiality and security measures.
IV. For external processing (service providers)
We may engage service providers, agents or contractors to provide services on our behalf, including to administer CLA Sites and services available to you. These third parties may come to access or otherwise process your personal data in the course of providing these services.
The CLA requires such third parties, who may be based outside the country from which you have accessed the CLA Site or service, to comply with all relevant data protection laws and security requirements in relation to your personal data, usually by way of a written agreement.
V. Compliance with laws
We will share personal data with third parties outside of the CLA if we have a good-faith belief that access, use, preservation or disclosure of the personal data is reasonably necessary to:
- Meet any applicable law, regulation, legal process or enforceable governmental request
- Enforce applicable Terms of Use, including investigation of potential violations
- Detect, prevent or otherwise address fraud, security or technical issues
- Protect against harm to the rights, property or safety of the CLA, our users or the public as required or permitted by law
5. “Cookie Notice”
5.1 About cookies
A cookie is a small piece of information that a web server asks the user’s browser to store on the user’s local computer, and then later their browser presents this information to the web server. In its simplest form, a cookie is an identifying number.
5.2 What type of cookies do we use?
We use two types of cookies on CLA Sites: persistent cookies and session cookies. A persistent cookie helps us recognize you as an existing user, so it's easier to return to CLA Sites or interact with our services without signing in again. In the event you sign up to one of our platforms, a persistent cookie stays in your browser and will be read by the service when you return to one of our sites. Session cookies only last as long as the session (usually the current visit to a website or a browser session).
We use cookies for anonymous user tracking. The CLA web server assigns each user a unique numerical ID (“ID”). All requests for pages are tagged with that ID, and by analyzing the log files, the CLA can determine how many unique users use CLA Sites.
5.3 How do we use cookies?
The CLA does not know the identity of a person based on the ID. The cookies used by the CLA do not contain any personal data about you nor are they used to look up your personal data. Even if you have entered personal data about yourself in one of the CLA’s registration forms, the CLA does not relate that information to the cookie data.
The CLA Sites may use cookies for analytics and to improve your user experience. CLA Sites will usually not natively use cookies but our analytics providers do use these cookies to improve user experience.
Our analytics providers include:

These providers use cookies to tailor your user experience, gather statistics on usage and engagement and help better inform the CLA’s efforts to deliver world-class engagement, knowledge and events.
You are free to decline the cookies if your browser or browser add-on allows, except if the cookies are required to prevent fraud or ensure the security of CLA Sites that the CLA controls. However, disabling the use of cookies will result in a less user-friendly experience of the CLA Sites or can fully prevent you from using the CLA Sites.
6. How do we store or transfer your data?
The CLA has offices and facilities in Germany, the United States, Japan and China. The hosting facilities for our websites and CLA Custom Platforms are situated in Germany and the EU, the Chinese website is hosted in Singapore.
When transferring personal data internationally, we make sure that we comply with applicable laws and regulations, for example, by entering into agreements that will ensure that the recipients of your information maintain an adequate level of data protection.
Information collected within the European Economic Area (“EEA”) may, for example, be transferred to countries outside of the EEA for the purposes as described in this Policy. We utilize standard contract clauses approved by the European Commission, adopt other means under Swiss and European Union law and/or obtain your consent to legitimize data transfers from the EEA to the United States and other countries.
7. Security of personal data

We receive this data from you and from the provider of the platform when you interact with us through our online presences (e.g. when you communicate with us via our online presences, view, comment or share our content we post or visit our online presences). At the same time, the providers of the platforms may analyze your use of our online presences (e.g. the way you interact with us, how you use our online presences, what you view, comment or «like») and process this data together with other data they have about you (e.g. information about your age and your gender and other demographic information). In that way, they create profiles about you and statistics on the use of our online presences. They use this data and profiles to display our or other advertisements and other personalized content on the platform and to manage the behavior of the platform, but also for market and user research and to provide us and other parties with information about you and the use of our online presence. Where we are jointly responsible with the provider for certain types of processing, we will conclude a corresponding agreement with such provider. You may obtain information about the material content of this agreement from the provider. They also process this data for their own purposes, in particular for marketing and market research purposes (e.g. to personalize advertising) and to manage their platforms (e.g. to decide what content they show you) and, to that end, they act as separate controllers.
We are entitled but not obliged to review contents prior to or after their publication on our online presences, to delete contents without notification, and to report them to the provider of the platform in question, if necessary. When rules of decency and codes of conduct are violated, we may also notify the provider of the platform of the user account in question for blocking or deletion.

Alert on Fictitious ‘CLA’ E-mails and messages
Like many organizations, fraudulent email, text messages and messages from fraudulent or fake social media profiles are being sent by individuals purporting to be representatives of the Conscious Leadership Academy.
These email and text messages have in the past used the names of the CLA’s management team, with ‘Reply To’ addresses that do not end in @consciousleadershipacademy.org. They may use Yahoo, Gmail or Hotmail accounts, and occasionally similar addresses (e.g. @consciousleadershipacademy.org).
Furthermore, fake profiles on Linkedin or other social media networks have been used to request payment for CLA events or other CLA activities.
Typically, these messages take the form of invitations offering membership, the possibility of participating in CLA events as an individual or as part of a delegation, or offers of employment. They often ask the potential victim to respond for further information. The CLA also received reports about SMS (text messages) claiming to provide awards or grants and either asking the individuals to call a fraudulent number or fill out a form with their personal information or credit card details.
Ultimately the recipient will be asked to provide personal information (passport, bank and other personal details), and finally payment (usually via Western Union or MoneyGram) to a fictitious CLA representative.
These emails and text messages are not legitimate Conscious Leadership Academy communications, and are in most cases a form of advance fee fraud. Their objective is to mislead victims into paying for a fictitious membership, event registration or “training course” prior to an offer of employment. Their objective may also be to commit identity theft.

- Emails from the Conscious Leadership Academy are only sent from addresses ending in: @consciousleadershipacademy.org, To assist mail providers and your IT team in the identification and filtering of fraudulent messages, the Conscious Leadership Academy maintains an up-to-date SPF (Sender Policy Framework) record.
- Participation in the Annual Meeting is by invitation only and is reserved exclusively for Members of the Conscious Leadership Academy and invited guests.
- Employment opportunities are published on the website of the Conscious Leadership Academy and are never advertised via unsolicited email communications. The Conscious Leadership Academy does not use Western Union or MoneyGram to receive payments.
- No awards, grants or equivalent are granted by the Conscious Leadership Academy via text messages or emails.
If you have received such emails or have any doubts about the authenticity of a text message or a social media contact that you supposedly received from the CLA please forward the message to [email protected] for verification. Anyone who receives a text message and suspects it to be fraudulent or a scam should delete it. Anyone who has already provided personal information and credit card details in response to these fraudulent text messages should contact their bank or credit card company immediately to notify them of the possible attempt at identity theft.
